These terms govern your use of the Road Worthy Games mobile application and the roadworthygames.com website (together, the "Service"), published by Bay Tech Ltd. ("Bay Tech", "we", "us"), a company incorporated in Manitoba, Canada. By using the Service you agree to these terms.
Road Worthy is intended for use during travel, including by drivers using voice only. Notwithstanding the app's hands-free design:
Bay Tech is not responsible for any accident, injury, loss, or damage arising from use of the Service while driving or travelling.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment. You may not copy, modify, reverse-engineer, resell, sublicense, or distribute the Service or its content, or use it to build a competing product.
All game content — including questions, answer boards, the Miles character, audio, artwork, the Road Worthy name and logo, and the software itself — is owned by Bay Tech Ltd. and protected by copyright and trademark law. Road Worthy Games™ is a trademark of Bay Tech Ltd.
You agree not to use the Service to break the law, to harass anyone, or to interfere with its operation or security.
The Service does not currently offer in-app purchases. If purchases are offered in future, they will be processed by Apple or Google under their terms, and their refund policies will apply. Voluntary tips or contributions, if offered, are non-refundable and do not entitle you to any product, service, or feature.
We may change, suspend, or discontinue any part of the Service at any time, including game content and features. We may update these terms; continued use after an update means you accept the revised terms. The date at the top of this page reflects the current version.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that voice recognition will accurately understand any given speaker, accent, or environment.
To the maximum extent permitted by law, Bay Tech Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months preceding the claim, or CAD $50.
Nothing in these terms limits liability that cannot be limited under applicable law, including under consumer protection legislation.
You agree to indemnify and hold harmless Bay Tech Ltd. from any claim or demand arising out of your breach of these terms or your misuse of the Service.
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein. The courts of Manitoba have exclusive jurisdiction, subject to any mandatory consumer protection rights available to you where you live.
Apple and Google are not parties to these terms and have no responsibility for the Service. Where the app is obtained through the App Store, Apple's standard End User Licence Agreement applies in addition to these terms, and Apple is a third-party beneficiary entitled to enforce them.
